These Terms of Service ("Terms") are a legal agreement between you and Nibbly (operated by Lyubomir Genchev, "we", "us", "our") governing your use of the Nibbly mobile application and this website (the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
1. Acceptance of terms
By downloading, accessing, or using Nibbly, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 16 years old to use Nibbly, because the Service handles health and body-metric information. By using the Service, you represent that you meet this requirement and that the information you provide is accurate. Nibbly is not intended for anyone with a medical condition, eating disorder, or other circumstance for which calorie tracking may be harmful without professional guidance.
3. Your account
You are responsible for keeping your account credentials secure and for all activity that happens under your account. Notify us promptly at nibblyapp@gmail.com if you suspect unauthorized use. You may sign in with email and password or with Sign in with Apple.
4. Subscriptions, trial, and billing
Nibbly is a premium subscription app. Full access to the app requires an active subscription with a valid premium entitlement. We offer:
- Monthly plan — a 3-day free trial, then €5.99/month.
- Yearly plan — a 3-day free trial, then €39.99/year.
Prices are shown in EUR and may vary by region and over time. The exact price, billing period, and trial length are always displayed on the purchase screen before you subscribe.
Auto-renewal. Subscriptions are billed through your Apple App Store account and renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. If you don't cancel during the free trial, your paid subscription begins automatically when the trial ends. Your Apple ID is charged at confirmation of purchase and at each renewal. Any unused portion of a free trial is forfeited when you purchase a subscription.
5. Cancellation & refunds
You can manage or cancel your subscription anytime in your device's App Store settings (Settings → your name → Subscriptions). Cancellation takes effect at the end of the current billing period; you keep access until then. Because purchases are processed by Apple, refunds are handled under Apple's App Store refund policy — request one through reportaproblem.apple.com. We generally cannot issue refunds directly for App Store purchases.
6. Health disclaimer
Nibbly is not a medical device and does not provide medical advice. All calorie goals, macro targets, and nutrition figures are estimates provided for general informational and motivational purposes only. They are not a substitute for professional medical, nutritional, or dietary advice, diagnosis, or treatment.
Always consult a qualified healthcare professional before starting any diet or making significant changes to your eating habits, especially if you are pregnant, nursing, under medical care, or have a history of disordered eating. Nibbly is designed to encourage healthy, sustainable consistency and never endorses starvation or extreme restriction. You use the Service at your own discretion and risk.
7. AI-generated estimates
The AI meal-scanning feature analyzes photos you provide to generate estimated calorie and macronutrient values. These estimates can be inaccurate or incomplete and are shown to you as editable suggestions. You are responsible for reviewing and adjusting results before saving them. Do not rely on AI estimates where accuracy is critical to your health.
8. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Reverse engineer, decompile, or attempt to extract source code, except where permitted by law.
- Interfere with, disrupt, or place undue load on the Service or its infrastructure.
- Access another user's account or data, or attempt to bypass security or usage limits.
- Upload unlawful, harmful, or infringing content, or content that is not a photo of food when using meal scanning.
- Resell, sublicense, or commercially exploit the Service without our written permission.
9. Intellectual property
The Service, including its software, design, the Nib mascot, logos, and content, is owned by Nibbly and its licensors and is protected by intellectual-property laws. You retain ownership of the content you submit (such as your meals and photos), and you grant us a limited license to process it solely to provide the Service to you as described in our Privacy Policy.
10. App license (End User License Agreement)
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Nibbly app for your personal, non-commercial use on Apple devices you own or control, as permitted by the App Store Terms of Service.
Apple-specific terms
The following applies because Nibbly is distributed through the Apple App Store:
- These Terms are between you and Nibbly only, not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, or costs are our responsibility, not Apple's.
- Apple is not responsible for addressing any claims by you or third parties relating to the app, including product-liability, legal/regulatory, or consumer-protection claims.
- In the event of a third-party claim that the app infringes intellectual-property rights, Nibbly (not Apple) is responsible for the investigation, defense, settlement, and discharge of such claim.
- You represent that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting," and that you are not on any US Government restricted-parties list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required by law. On termination, your right to use the Service ends; sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will remain in effect.
12. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that estimates will be accurate. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law, Nibbly and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or €50. Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Governing law & disputes
These Terms are governed by the laws of Bulgaria, without regard to conflict-of-laws rules. The courts located in Varna, Bulgaria will have exclusive jurisdiction, except where mandatory consumer-protection law in your country of residence provides otherwise. If you are a consumer in the EU, you retain the protections of the mandatory laws of your country of residence.
15. Changes to these terms
We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
